1.2 To become a user of "www.rpnarrative.com” and use the services of such Website, You must carefully read the present Terms of Use as available herein and accept their related terms and conditions by ticking the box "I agree to the TERMS OF USE AND PRIVACY DATA POLICY, and the COMMUNITY GUIDELINES”. Additionally, you must be over 13 years old and above the age required by the laws of your country to use the Website, or we need to have received verifiable consent from your parent or legal guardian.

If You are using the Website on behalf of any other entity, You have full legal authority to represent and warrant that You are authorized to accept these Terms of Use on their behalf and to bind such entity to these Terms of Use noting that in such event, the word "User” will refer to the other entity.

1.4 These Terms of Use are entered into by and between The Collective Mind (herein referred to as "The Collective Mind,” "we,” "us,” or "our”) and yourself (the "User” or "You”). It shall govern the aforesaid relationship. These Terms of Use shall be effective for an undetermined term commencing as at the date of your registration as a User and creation of a User Account, in accordance with Section 2 of these Terms of Use.


 

Section 2: User Account

2.1 In order to create a User Account (an "Account”) , You must:

  • be over 13 years old and above the age required by the laws of your country on the signing up day; and

  • have filled the mandatory fields of the online sign up form.

At the end of the signing up process, You will receive a welcoming message on the valid registered email address.

2.2 You must sign up using a valid email address, correct date of birth, and certain other information about your preferences. The nature of the data collected during the signing up process and the objectives of this collection are specified in the Privacy Data Policy.

2.3 During the signing up, You must choose a password which shall remain strictly confidential. You shall not communicate and/or share your password with anyone. You are the only person authorized to use this password in order to access the Website and its services.

2.4 You are solely liable for any information associated with your Account and anything that happens related to your Account including the use of your username and password by a third party and will bear all the material and moral damages and any other consequence whatsoever resulting from such use of your username and/or your password by any third party whether authorized or not by You. 3.1 The Website allows Users to create character(s) linked to their Account, then facilitates communications and interactions between other User’s characters ("Services”).

3.2 You acknowledge and agree that The Collective Mind does not provide any service to the customer other than access to a relevant database of content created on the Website, and does not provide services to Users apart from a platform to communicate, share, and plot their character stories. As such, the role of "www.rpnarrative.com” merely consists of providing a platform permitting the exchange of information and communications (in the form of plots, stories, etc.) .

3.3 You shall use the Website related Services in order to communicate with other Users, and shall be prohibited and personally liable for any misuse including:

  • license, sell, transfer, assign, distribute, host, or otherwise commercially exploit the Website, the Services, Account or Content;

  • modify, prepare derivative works of, disassemble, decompile, or reverse engineer any part of the Website, the Services or Content; or

  • access tWebsite, the Services or Content in order to build a similar or competitive website, product, or service.

3.4 The Services include facilitating communications and interactions between users, but the Services do not include managing disputes related to those interactions.

3.5 The Collective Mind is not liable for any potential hyperlink posted online by Users which cannot be monitored by it. Therefore, The Collective Mind cannot be liable for any content, advertising, product, service or any other element available on or from those websites.

3.6 The Collective Mind is not liable for posted advertisements, only their authors are. The Collective Mind is therefore not liable for any prejudice or loss resulting from potential advertisements.

3.7 The Collective Mind reserves the right to modify, suspend, or discontinue the Services (in whole or in part) at any time, with or without notice to you. Any future versions, updates or other additions to the service features are subject to these terms and conditions, which may be updated from time to time.

The Collective Mind takes no responsibility for and does not endorse, support, or guarantee the completeness, truthfulness, accuracy, or reliability of any of the Content.

4.2 By submitting User Content to the Website, You represent and warrant that you have all rights, power, and authority necessary to grant the rights to your User Content contained within these Terms of Use. You alone are responsible for your User Content, and acknowledge that You are liable for any intellectual property infringing User Content you share or post on the Website.

4.3 You retain any ownership rights you have in your User Content. You agree that You grant The Collective Mind a license to use the content provided by You on the Website, for the purpose of displaying the content on the Website and enabling the Services mentioned in the present Terms of Use. This license is worldwide.

 

4.4 Any ideas, suggestions, and feedback about the Website are entirely voluntary, and You acknowledge and agree that The Collective Mind may use such ideas, suggestions, and feedback without compensation or obligation to You.


Section 5: Obligations of the Users

  • Content that infringes upon the intellectual property rights of other users or third parties; encourages bodily harm; content that constitutes false advertising, false advertising regulations; content intended to collect personal or personally identifiable information from users or third parties;

  • Content which affects property rights of others, including intellectual property (such as authors’ rights, registered trademarks, patents, pictures and models);

  • Not to use the Website for political or religious propaganda or promotion of any sorts;

  • Not to insert on the Website or in the messages and communications sent to other Users hyperlinks to the above mentioned unlawful contents;

  • Not to block, overload, modify or copy contents from the Website, unless it is necessary to the proper use of the Services provided by the Website;

You may not become a User unless You have submitted the mandatory information that enables The Collective Mind to identify You as a future User. The mandatory information conditions your registration as a User, and allows You to benefit from the Services offered through the Website in compliance with these Terms of Use.

7.2.2 During or after signing up to the Website and becoming a User, You may provide additional information particularly related to the User Content You may decide to post on the Website ("Optional data”). Such Optional data shall be provided at your sole discretion in order to improve your benefits from the Website's services and increase your chances to communicate and interact with other Users

7.2.3 In case the provided Optional data reveal your ethnic origins and/or religion and/or other personal information, then You shall give your express consent to the process of such "sensitive” data, and accept to bear the responsibility thereof

7.2.4 The personal pen name, date of birth, email address and the password You have registered when signing up as a User are strictly confidential. They cannot be accessed or viewed by any other User. The Collective Mind shall not transfer your personal data to any third party.

 

7.3 Cookies

7.5.2 The Collective Mind will endeavor to take all reasonable steps in order to protect your personal data in its database, and to limit the access to this data to the personnel to the employees who should have access to it on a need to know basis (CRM and technical team).

7.5.3 However, The Collective Mind does not warrant in any case whatsoever that the data concerning its Users’ accounts are 100% secure, given the ever possible unauthorized consultations or uses of the data, the hardware or software errors and defaults and any other factor which could compromise the security of Users’ data.

 

7.6 Right of access to data

7.6.1 You shall have the right to access, rectify and/or suppress any and/or all your personal data which are collected when You sign up for the Website or its Services.

7.6.2 Every User shall have direct online access to the most important part of his/her personal data posted on the Account setting’s page. As such, You may modify, at any time and at your sole discretion, your personal Account information and your profile.

7.6.3 A User can request the destruction or the modification of his/her personal data collected by The Collective Mind, using the "contact us” function and specifying his/her name and his/her personal registered email address.

 

7.5 Recipient of the data

7.7.1 The Collective Mind is the only recipient of the collected personal data. It will not transmit your data to any other User, at any time. However, The Collective Mind may transfer general socio-demographic non personal information and electronic identification data (i.e. information calculated or created on or from your computer when You connect to the Website and which enable it to monitor, without identifying You, your behavior as an Internet user) to its partners. The collected data are processed for studies, statistics or commercial purposes (banners, commercial offers), in order to better target the advertisements (considering the age, the behavior, etc.).

7.6 The Collective Mind may disclose User’s information to:

8.1 The Collective Mind does not represent, warrant or guarantee that any User is reputable or will act in accordance to the registered preferences. The Collective Mind does not control, endorse, or take responsibility for any content available on or linked to the Website or the actions of any third party or Users.

8.2 Even though The Collective Mind is using its best efforts to ensure the availability of the Website without interruption and your access to and use of our services safe, You acknowledge and agree that it is technically impossible to achieve a 100% Website availability. Therefore, The Collective Mind cannot be held liable for any inconvenience resulting from bugs, viruses or other harmful components or interruptions, in particular due to maintenance, technical enhancements and updates or any other force majeure event. The Collective Mind does not warrant that the services are accurate, complete, reliable, current, or error free.

8.3 The Collective Mind shall not be liable for any failure, impossibility to access and/or bad conditions of use resulting from inadequate equipment and/or malfunctioning internet connection, obstruction of the network, potential failure of the Website’s host or any other external reason.

8.4 The User waives any legal action against The Collective Mind based upon any infringement of his/her image rights and respect of his/her right to privacy, resulting from the broadcasting or disclosure of personal information, provided that this broadcasting/disclosure did not arise from The Collective Mind’s breach of contractual and/or legal obligations. User shall only disclose non confidential information which is not prejudicial to anyone, specifically to another User.


 

Section 9: Indemnification

You shall indemnify and hold The Collective Mind harmless against all actions, including damage claims, infringement claims, privacy invasion claims, asserted by other Users or third parties, in connection with your use of the website, your communication with other Users and/or in connection with the Content You post on the Website. You shall bear all costs resulting from such claims (including The Collective Mind’s attorneys’ fees).


 

Section 10: liability

10.1 The User releases The Collective Mind and its directors, agents or employees of any liability arising (whether directly or indirectly) out of the information provided on the Website or through the use of the Website or any errors in, or omissions from information on the Website. The Collective Mind is not liable for any damage to any User, and is not obliged to compensate in any way.

10.2 The Collective Mind will not be held liable under any circumstances for any special, consequential, incidental, exemplary or indirect costs or damages, litigation costs, installation and removal costs, loss or damage of data, production, profit, turnover, time or reputation suffered by the User in connection with the use of the Website. The Collective Mind will also not be liable under any circumstances for any loss arising out of reliance on the information on or provided to the User through the Website or provided to a User by another User on the Website, nor any interruption, delay or impairment in the functioning, operation or availability of the Website, exposure to or transmission of any computer virus, internet access difficulties in connection with the Website, or malfunction in equipment or software. Section 11: Refund Policy

The Collective Mind will not refund the User for any Paid Services and/or products purchased, regardless of the underlying reason. No refunds will be issued for events including but not limited to:

  • The User changing their mind about the purchases executed on the Website.

  • The User’s accidental purchases of any Paid Services and Products

  • Termination of the Users’ Account under any and all circumstances.


Section 13: Intellectual property

13.1 The Collective Mind owns every intellectual property right in the texts, images, graphics and logos appearing on the Website (the "IP Rights”). The IP Rights cannot be copied, used or represented without The Collective Mind’s prior written consent.

13.2 By using the Website, You grant The Collective Mind the license to use your User Content worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to use, copy, modify, adapt, prepare derivative works of, distribute, store, perform, and display you User Content and any name, username, voice, or likeness provided in connection with your User Content in all media formats and channels now known or later developed anywhere in the world. This license includes the right for us to make your User Content available for syndication, broadcast, distribution, or publication by other companies, organizations, or individuals who partner with The Collective Mind. You also agree that we may remove metadata associated with your User Content, and You irrevocably waive any claims and assertions of moral rights or attribution with respect to your User Content.

13.3 Users are not allowed to modify, copy, reproduce, download, broadcast, transmit, exploit and/or distribute, by any way, services and pages provided through the Website other than as required to use the Services supplied through the Website.

13.4 You acknowledge and agree that The Collective Mind may modify the content You post on the Website in order to conform to the graphic charter of the Website and/or adapt your content to the technical performances and the charter of the Website. Although we have no obligation to screen, edit, or monitor your User Content, we may, in our sole discretion, delete or remove your User Content at any time and for any reason, including for violating these Terms of Use, violating our Community Guidelines, or if you otherwise create or are likely to create liability for us.

13.5 You acknowledge and agree that The Collective Mind has the right to remove any infringing material to the intellectual property from the Website and to the termination, in appropriate circumstances, of Users of the Website without any prior notice.


 

Section 14: Termination of User Account

14.1 A User can terminate their access to the Website at any time. The User data will be removed off the Website within 48 hours. Termination will not give ground to any refund rights on any purchases or upgrades.

 

14.2 The Collective Mind may terminate these Terms of Use with the User, at any time and for any reason by suspending, terminating, deleting or otherwise restricting the User’s access to the Website or the Services, including but not limited to the events where:

  • The User does not comply with the applicable laws or promotes activities not compliant with the public order and the Terms of Use;

  • The participation of the User to the Website harms the reputation of the Services provided by The Collective Mind;

  • Prolonged User inactivity.


Section 15: Governing law and jurisdiction

15.1 If Any litigation or dispute pertaining to these Terms of Use and/or to any of the provisions arise, you agree to raise it and try to resolve it with The Collective Mind informally. You can contact us with feedback.

15.2 The separation of disputes is governed by Sharjah Publishing City - Free Zone Authority.
